SC Compulsory Attendance Laws

§59-65-10: Compulsory attendance: This outlines the responsibility of parents and the school district in respect to public school attendance between the ages of five (5) and seventeen (17).

§59-65-20: Penalty: What are the penalties for failure to attend in compliance with Section 59-65-10?

§59-65-30: Exceptions: There are some for whom the above sections of the law do not apply. Can that be you?

SC Homeschooling Legal Options

 We recommend:
§59-65-47. Home School Associations (“Third Option”) This gives homeschoolers a wide variety of home school associations under which to conduct their schooling. This option allows for greater parental control and is usually more cost effective depending, of course, on the association chosen. PACESC is proud to be one of these “third option” associations.

Other options available:

§59-65-45. South Carolina Association of Independent Home Schools (Second Option): SCAIS was the first legal alternative to district approval to home school.

§59-63-100: Homeschool students are now eligible to participate in public school interscholastic sports and activities: The Equal Access to Interscholastic Activities Act was signed into law by Governor Nikki Haley. What this means for homeschool children...

South Carolina has granted equal access to home school students to public school interscholastic activities. It is the student's responsibility to attend the initial try-outs/practices and provide the coach/school with any additional information or documentation necessary to verify that the student is eligible to compete (i.e., transcripts, physical exam, birth certificate, etc.).
